SMS Communications Terms & Conditions

These SMS Communications Terms & Conditions (“SMS Terms”) govern SMS communications generated through the PlateSmart Automatic License Plate Recognition (“ALPR”) platform.
These SMS Terms supplement the PlateSmart Terms of Service and Privacy Policy.
1. SMS Program
The PlateSmart platform supports SMS communications for authorized users of the PlateSmart ALPR platform.
At the time these SMS Terms become effective, SMS communications are limited to:
- Vehicle Watchlist Alert Notifications
- Two-Factor Authentication (2FA) Verification Codes
SMS communications are generated automatically based upon customer-configured events and authorized user activity.
2. Administration of SMS Services
SMS services may be administered by either:
- PlateSmart on behalf of the customer; or
- The customer using a supported third-party messaging service.
The applicable administration model is determined by the customer’s deployment and service agreement.
3. Authorized Use
SMS functionality is intended solely to support the operation and security of the PlateSmart platform.
Customers agree to use SMS functionality only for lawful purposes and in accordance with applicable laws, regulations, wireless carrier requirements, and organizational policies.
SMS communications shall not be used for unsolicited marketing, advertising, or any unlawful purpose.
4. Recipient Authorization
Customers are responsible for ensuring that recipients are authorized to receive SMS communications where required by applicable law or organizational policy.
Where PlateSmart administers SMS services on behalf of a customer, PlateSmart acts solely as the customer’s service provider.
5. Message Frequency
Message frequency varies based upon:
- Vehicle watchlist activity.
- User authentication requests.
- Customer system configuration.
PlateSmart does not guarantee a minimum or maximum number of SMS communications.
6. Message Charges
Standard message and data rates imposed by a recipient’s wireless carrier may apply.
Recipients are responsible for any applicable carrier charges.
7. Availability
SMS delivery depends upon third-party messaging providers, telecommunications carriers, customer infrastructure, and recipient devices.
PlateSmart does not guarantee uninterrupted, timely, or error-free delivery of SMS communications.
8. Third-Party Messaging Providers
SMS communications may be delivered through one or more supported third-party messaging service providers.
The messaging provider may differ depending upon the customer’s deployment model.
9. Suspension of SMS Services
PlateSmart reserves the right to suspend or discontinue SMS functionality where reasonably necessary to:
- Protect platform security.
- Maintain system integrity.
- Comply with applicable law.
- Comply with messaging provider or wireless carrier requirements.
- Prevent misuse of SMS functionality.
10. Limitation of Liability
PlateSmart shall not be responsible for delays, failures, filtering, blocking, or non-delivery of SMS communications caused by wireless carriers, messaging providers, telecommunications networks, customer infrastructure, recipient devices, or events outside PlateSmart’s reasonable control.
11. Changes to these SMS Terms
PlateSmart may modify these SMS Terms from time to time.
Continued use of SMS functionality following publication of revised SMS Terms constitutes acceptance of the updated Terms.
